Foreign Investment

Setting up a PT PMA, checking business fields against the Positive Investment List, OSS-RBA licensing, and LKPM reporting.

We guide foreign investors through setting up a PT PMA, from checking the business field against the Positive Investment List and determining the KBLI code, to obtaining licences through the OSS-RBA system. We also confirm that the capital structure meets the minimum investment requirements in force at incorporation.

Once the company is operating, we assist with periodic investment activity reports (LKPM) to the Ministry of Investment/BKPM, with the setup of representative offices (KPPA), and with investor visas and KITAS for directors, commissioners, and foreign staff. Our approach is to design a structure that fits the business plan rather than simply completing paperwork.

Frequently asked questions

What is the Positive Investment List, and how does it affect a PT PMA?

The Positive Investment List sets out the business fields open to foreign investment, including fields with foreign ownership caps or conditions. Before incorporating a PT PMA, the chosen business fields should be checked against the list, because an incorrect KBLI code can cause licensing problems.

Does a PT PMA have to report its activities periodically?

Yes. A PMA company must submit its Investment Activity Report (LKPM) periodically through the designated system, and late or inconsistent filings can lead to administrative sanctions. Recording investment realization data from the start of the year makes reporting easier.

Is there a minimum amount of foreign capital required?

Yes. Minimum investment value and paid-up capital requirements apply to a PT PMA. The amounts may vary by business activity and change with regulation, so the requirement in force at the time of incorporation should be verified before the deed is prepared.
