Litigation and Arbitration

Representation in civil and commercial disputes before the District Courts, appeals and cassation, and BANI and SIAC arbitration.

Our litigation team handles civil and commercial disputes before the District Courts, from drafting claims and defenses through evidence and hearings. Where needed, we also represent clients on appeal to the High Court and on cassation to the Supreme Court (Mahkamah Agung).

For disputes governed by an arbitration clause, we act before the Indonesian National Board of Arbitration (BANI) and the Singapore International Arbitration Centre (SIAC). We also assist with enforcing domestic and foreign arbitral awards, and with mediation as a faster and more controllable route to settlement.

What we do

  • Claims, answers, and defenses in civil disputes before the District Courts
  • Breach of contract (wanprestasi) and unlawful act (perbuatan melawan hukum) claims
  • Appeals, cassation, and judicial review (peninjauan kembali)
  • Arbitration before BANI and SIAC, including arbitrator appointment and hearings
  • Enforcement of domestic arbitral awards and recognition of foreign arbitral awards
  • Mediation inside and outside the court process
  • Drafting dispute-resolution clauses for contracts

Frequently asked questions

Must a contract dispute be resolved in court or in arbitration?

It depends on the dispute-resolution clause in the contract. If the parties agreed to arbitration, the dispute is generally brought before the chosen arbitral institution; otherwise, the competent District Court is the forum.

How long does a civil case take in the District Court?

Duration varies widely depending on the complexity of the evidence, the number of parties, and the court’s schedule. A complex case can take several years if it proceeds through appeal and cassation, which is why mediation is often considered early on.

Can a foreign arbitral award be enforced in Indonesia?

Indonesia is a party to the 1958 New York Convention, so a foreign arbitral award may be recognized and enforced, subject to certain conditions. The award is registered and exequatur sought at the Central Jakarta District Court, which examines the formal requirements and the grounds for refusal set out in applicable rules.
